Distance Sales Agreement

This Distance Sales Agreement ("Agreement") is entered into between the parties identified below, in accordance with the Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
1. Parties

Buyer information is recorded during the checkout process.
2. Subject of the Agreement
This Agreement governs the sale and delivery of the Rezask cloud-based appointment scheduling service ("Service"). The Service includes online booking management, staff scheduling, client management, automated reminders, and related features as described on the Rezask website and selected subscription plan.
3. Price & Payment
Service prices are displayed on the Rezask pricing page inclusive of all applicable taxes (KDV). Subscription plans are billed monthly or annually as selected by the Buyer. Payments are processed securely through iyzico payment infrastructure. The Seller reserves the right to update pricing with 30 days' advance notice. Existing subscriptions continue at their current rate until the end of their billing cycle.
4. Delivery
The Service is a digital product delivered electronically. There is no physical shipment. Upon successful payment confirmation, the Service is activated instantly and the Buyer receives immediate access. A confirmation email is sent to the Buyer's registered email address.
5. Right of Withdrawal
Under the Distance Contracts Regulation, consumers have a 14-day right of withdrawal from the date of purchase. However, in accordance with Article 15(ğ) of the Regulation, this right does not apply to digital content that has been accessed or services that have been performed, where the consumer has given prior explicit consent to immediate performance and has acknowledged that the right of withdrawal will be waived. At checkout, the Buyer is asked to confirm: "I consent to immediate activation of the service and acknowledge that I waive my 14-day withdrawal right upon accessing the service."
6. Cancellation & Refunds
The Buyer may cancel their subscription at any time through the dashboard. The subscription remains active until the end of the current billing period. Refunds are provided for: (a) duplicate or erroneous charges, (b) system errors preventing service delivery, (c) billing errors. Refund requests must be sent to hello@rezask.com within 30 days of the charge. Approved refunds are processed within 14 business days.
7. Subscription Terms
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled by the Buyer before the renewal date. The Buyer will be notified via email at least 7 days before auto-renewal. Upon cancellation, the Buyer retains access until the end of the paid period. After expiration, the account is downgraded to the free tier.
8. Intellectual Property
All software, content, trademarks, and intellectual property associated with Rezask are owned by [ŞİRKET_UNVANI]. The Buyer is granted a limited, non-exclusive, non-transferable license to use the Service for the duration of their active subscription. The Buyer may not copy, modify, distribute, or reverse-engineer any part of the platform.
9. Personal Data Protection
Personal data is processed in accordance with the Turkish Personal Data Protection Law No. 6698 (KVKK) and our Privacy Policy. By using the Service, the Buyer consents to the processing of their personal data as described in the Privacy Policy, which is available at /privacy.
10. Dispute Resolution
This Agreement is governed by the laws of the Republic of Turkey. For disputes arising from this Agreement, the Consumer Arbitration Committees (Tüketici Hakem Heyeti) have jurisdiction for claims up to the statutory threshold. For claims exceeding this threshold, the courts and enforcement offices at the Buyer's or Seller's place of residence are authorized. The current monetary thresholds for Consumer Arbitration Committees are determined annually by the Ministry of Trade.
11. Effective Date
This Agreement becomes effective on the date the Buyer completes their purchase and payment is successfully processed. By completing the purchase, the Buyer confirms that they have read, understood, and accepted all terms of this Agreement.
